Pierrefonds man sentenced to 19 months in child porn case

A Pierrefonds man found to have a large collection of child pornography while his wife operated a private daycare out of their home on the West Island has been sentenced to a 19-month prison term.

Quebec Court Judge Claude Parent sentenced Kimberley Byron Moskalewski, 53, to the prison term on Friday at the Montreal courthouse. It will leave Moskalewski with 5 months left to serve on top of the time he has already spent behind bars since his arrest last year.

On Feb. 16, Moskalewski pleaded guilty to producing, distributing and possessing child pornography. He also admitted to secretly recording a video of a young girl while she tried on clothes. He offered the video, through a Facebook page, to pedophiles and encouraged men to lure the girl.

Moskalewski was also sentenced to two years of probation during which he will be required to follow any therapy program prescribed to him by an expert. He is also not allowed to communicate with the girl he videotaped and cannot use a computer during his probation. The latter condition can be modified if Moskalewski finds a job that requires he work with computers.

Prosecutor Carolyn Paquin had recommended a federal sentence – more than 2 years in a penitentiary – during sentencing arguments. On Friday she said she was disappointed with the sentence and suggested the judge did not place enough emphasis on the amount of child pornography Moskalewski had amassed by the time of his arrest. When police raided his home, they found more than 5,000 images of child pornography, as well as hundreds of videos, on computers they seized.
